Terms and conditions

These terms and conditions ("Terms") apply to your use of edengrovegreenhouse.com (the "Site") and to any session, studio rental, or visit at Eden Grove Greenhouse ("Eden Grove," "we," "us," or "our"). By using the Site, booking with us, or entering the property, you agree to these Terms. If you book for a group or for clients, you agree to these Terms on behalf of everyone in your group and are responsible for making sure they follow them.

1. About Eden Grove

Eden Grove is a greenhouse photo studio located in a natural wooded area on a private residential property in Anna, Texas. Visits are by appointment only. The property is still being developed, and some features are temporary or not yet available, as described in our FAQ.

2. Bookings and payment

Bookings and payments are made through Acuity Scheduling. A booking is confirmed only when you receive a confirmation. Prices, deposits, and availability are shown at the time of booking. By booking, you also agree to any terms presented by Acuity Scheduling.

3. Cancellations and rescheduling

We require at least 24 hours notice to cancel or reschedule. Deposits are nonrefundable. If your plans change, you may move your booking to another available date as long as you give at least 24 hours notice. We may cancel or reschedule a booking if conditions make a session unsafe or if an unexpected issue affects the property. If we cancel, we will work with you to reschedule or provide a refund of amounts paid for that booking.

4. Arrival and session time

You may enter the wooded area up to 10 minutes before your scheduled start time. Please wait until your exact start time to approach or enter the greenhouse, and leave the greenhouse by your scheduled end time so the space can be prepared for the next guest. Arriving late does not extend your booking. Additional time may be available case by case and may be charged.

5. Use of the property

• Stay within the greenhouse and designated wooded areas. The rest of the property is a private residence.
• Park where directed, partly in the grass and partly on the street in front of the home. Do not park completely in the street or block traffic.
• Confetti, glitter, smoke bombs, and candles are not allowed, except candles on a birthday cake. Ask us before bringing any unusual prop or setup.
• You may move furniture and decor for photos, but you must return everything to its original place before you leave.
• Do not climb or stand on furniture unless the piece is intended for that use.
• Take all personal belongings, trash, props, and decor with you when your session ends.
• One pet is allowed per booking. Pets must be under your control at all times, and you are responsible for cleaning up after your pet.
• Children must be supervised by an adult at all times while on the property.
• Illegal activity, alcohol or drug impairment, and any behavior that puts people or the property at risk are not allowed. We may end a session without refund if these Terms are not followed.

6. Facilities

The property and greenhouse are provided as they are. At this time there is no bathroom on the property and no permanent electricity in the greenhouse. Lighting after dark is limited, fans and heaters run by extension cord, and parking and the walkway are temporary. Furniture, decor, plants, and seasonal sets may change without notice. Images on the Site are renderings, and the actual greenhouse and sets may look different.

7. Damage and lost items

You are responsible for any damage to the greenhouse, furniture, decor, plants, or property caused by you, your group, your clients, or your pet, beyond normal wear. We may charge you for reasonable repair, cleaning, or replacement costs. We are not responsible for lost, stolen, or damaged personal belongings, equipment, or vehicles.

8. Assumption of risk

You understand that Eden Grove is in a natural, outdoor wooded setting and that visiting involves risks. These risks include, but are not limited to: uneven ground, tree roots, rocks, gravel, mud, and slippery surfaces; walking in heels or costume footwear; insects, plants, and wildlife; heat, cold, sun, rain, and other weather; limited lighting after dark; extension cords, fans, and heaters; furniture, props, and decor; dogs on neighboring property; and the trampoline and zip line on the property.

Use of the trampoline and zip line is optional and entirely at your own risk. Children may use them only with active adult supervision, and the supervising adult is responsible for their safety.

You choose to visit and participate voluntarily, and you knowingly accept these risks, both known and unknown, for yourself, your group, your clients, any children in your care, and your pet.

9. Release and limitation of liability

To the fullest extent permitted by Texas law, you release Eden Grove, its owners, family members, photographers, employees, and agents from any claims, losses, or damages arising out of your visit, your session, or your use of the property, including claims for personal injury, illness, property damage, or loss, except where caused by our gross negligence or willful misconduct.

To the fullest extent permitted by law, our total liability for any claim related to a booking or visit will not exceed the amount you paid for that booking. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost images, or lost business.

10. Indemnification

You agree to indemnify and hold harmless Eden Grove, its owners, family members, photographers, employees, and agents from any claims, damages, and expenses, including reasonable attorney fees, arising from your visit, the actions of anyone in your group or your clients, your pet, or your breach of these Terms. Photographers who bring clients are responsible for informing their clients of these Terms.

11. Photography and content

You own the photos and video you or your photographer create during your booking. Sessions with Brittany Bay are also subject to her own session agreement, which controls the use and delivery of those images. You may share images taken at Eden Grove, and we appreciate a tag. We may take photos of the empty greenhouse and sets for our own marketing.

All content on the Site, including text, design, logos, and images, belongs to Eden Grove or its licensors and may not be copied or used without permission.

12. Use of the Site

The Site is provided for general information. We try to keep it accurate, but we do not guarantee that it is complete, current, or free of errors, and we may change it at any time. The Site links to third-party sites, including Acuity Scheduling, which we do not control and are not responsible for. Your use of the Site is also subject to our privacy policy.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.

14. Other terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. We may update these Terms from time to time by changing the effective date above. Bookings are subject to the Terms in effect when the booking is made.
